1. Acceptance of Terms

By downloading, installing, accessing, or using JollyTrack, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and Iulian Gabriel Florea. Your continued use of the Service following any updates to these Terms constitutes your acceptance of those changes.

2. Eligibility

JollyTrack is designed to be family-friendly and suitable for users of all ages. However:

• Users under 16 years of age must have parental or guardian consent to create an account or make purchases
• Parents and guardians are responsible for supervising their children's use of the Service
• By allowing a minor to use the Service, you represent that you are the parent or legal guardian

3. User Accounts

Some features of the Service may require you to create an account. When creating an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Use of Service

JollyTrack provides a Santa tracking service and Christmas-themed content for entertainment and educational purposes. By using the Service, you agree to:

• Use the Service only for lawful purposes
• Use the Service in accordance with these Terms
• Not interfere with or disrupt the Service or servers
• Not attempt to gain unauthorized access to any part of the Service
• Respect the rights of other users

Note: Santa tracking is for entertainment purposes. Actual Santa location data is simulated and should not be relied upon for any real-world navigation or location purposes.

5. Subscriptions and In-App Purchases

5.1 Purchases

JollyTrack may offer in-app purchases and subscriptions. All purchases are processed through the Apple App Store or Google Play Store, and are subject to their respective terms and conditions.

5.2 Subscription Terms

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your App Store or Google Play account settings
• Any unused portion of a free trial period will be forfeited when purchasing a subscription

5.3 Refunds

All purchases are final. Refund requests must be directed to Apple or Google, as applicable, in accordance with their refund policies. We do not process refunds directly.

5.4 Price Changes

We reserve the right to change subscription prices. Price changes will be communicated in advance and will take effect at the start of the next subscription period.

6. Intellectual Property

All content and materials available through the Service, including but not limited to:

• Text, graphics, logos, icons, and images
• Software, code, and algorithms
• Design, layout, and user interface
• Audio, video, and animations
• The JollyTrack name and branding

are the property of Iulian Gabriel Florea or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, or publicly display any content without our explicit written permission.

7. User Content

You may be able to create or submit content through the Service (e.g., personalized cards, photos, or other user-generated content). By submitting content, you:

• Retain ownership of your content
• Grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the Service
• Represent that you have all necessary rights to submit the content
• Agree not to submit content that violates any laws or third-party rights

8. Prohibited Activities

You may not use the Service to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Transmit viruses, malware, or other harmful code
• Harass, abuse, or harm other users
• Collect user data without permission
• Impersonate any person or entity
• Use automated systems, bots, or scrapers to access the Service
• Attempt to reverse engineer, decompile, or disassemble the Service
• Circumvent any security measures or access restrictions
• Use the Service for any commercial purpose without our consent

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or completeness of content

We do not guarantee that the Service will be uninterrupted, secure, or error-free. Santa tracking features are for entertainment only and do not represent actual location data.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• We shall not be liable for any loss of profits, data, use, goodwill, or other intangible losses
• Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, these limitations may not apply to you to the extent prohibited by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Iulian Gabriel Florea and any affiliates, officers, agents, and employees from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, if:

• You violate these Terms
• We are required to do so by law
• We discontinue the Service

You may terminate your account at any time by deleting the app and contacting us to request data deletion. Upon termination, your right to use the Service will cease immediately.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.

For EU residents: You may also be entitled to use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

Any disputes arising from these Terms shall be resolved through good faith negotiation. If negotiation fails, disputes shall be submitted to the courts of Malaga, Spain.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of changes by:

• Posting the updated Terms on this page
• Updating the "Last updated" date at the top
• Sending you a notification through the app for material changes

Your continued use of the Service after changes constitutes acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the Service.
